Terms of Service

These Terms of Service ("Terms", "Agreement") govern your access to and use of ARITHMOS ("the App", "the Game", "the Service"), a real-time multiplayer math battle game developed and operated by Fikazon Technologies Ltd ("we", "us", "our", "the Company"). By downloading, installing, accessing, or using ARITHMOS, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility

ARITHMOS is available to users of all ages. However, the following conditions apply:

• Users under the age of 13 must have verifiable parental or guardian consent before creating an account or using the App.
• Users between the ages of 13 and 17 may use the App, but a parent or guardian is responsible for their activity and any transactions made.
• By using ARITHMOS, you represent that you have the legal capacity to enter into this Agreement, or that a parent or guardian has agreed on your behalf.

2. Account Registration

• You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately at info@fikazonsms.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
• You may not create multiple accounts to gain unfair advantages, manipulate leaderboards, or circumvent restrictions.

3. Acceptable Use

When using ARITHMOS, you agree NOT to:

• Use cheats, exploits, bots, scripts, or any unauthorized third-party software to gain an unfair advantage.
• Manipulate matchmaking, rankings, scores, or leaderboard positions through any artificial means.
• Harass, bully, threaten, or send abusive or offensive messages to other users.
• Impersonate another person, player, or Fikazon Technologies representative.
• Distribute spam, advertisements, or malicious links through any in-app feature.
• Attempt to reverse-engineer, decompile, disassemble, or extract the source code of the App.
• Interfere with, disrupt, or place an undue burden on the App's servers, networks, or infrastructure.
• Exploit bugs or glitches instead of reporting them. Known bugs should be reported to our support team.
• Use the App for any illegal purpose or in violation of any applicable laws or regulations.
• Collect or harvest other users' personal data without authorization.

Violation of these rules may result in warnings, temporary suspensions, permanent bans, and/or forfeiture of in-app currency and items, at our sole discretion.

4. In-App Purchases and Virtual Currency

4.1 Virtual Items

ARITHMOS may offer virtual currency ("Coins"), power-ups, cosmetic items, and other virtual goods ("Virtual Items") for purchase using real money or earned through gameplay. You acknowledge that:

• Virtual Items are licensed to you, not sold. You do not own Virtual Items; you receive a limited, non-transferable, revocable license to use them within the App.
• Virtual Items have no real-world monetary value and cannot be exchanged for real money, goods, or services outside the App.
• We reserve the right to modify, rebalance, or discontinue any Virtual Items at any time.

4.2 Purchases

• All purchases are processed through authorized payment providers (Google Play Billing, Paystack, Flutterwave, or other approved gateways).
• Prices are displayed in your local currency where supported and include all applicable taxes.
• You agree to pay all charges associated with your purchases at the prices in effect at the time of the transaction.

4.3 Subscriptions

If ARITHMOS offers subscription plans in the future, the following applies: subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period, you may manage and cancel subscriptions through your app store account settings, and no refunds will be issued for partial subscription periods unless required by law.

5. Intellectual Property

• All content in ARITHMOS — including but not limited to game design, graphics, animations, sounds, music, text, code, logos, and the ARITHMOS brand — is the exclusive property of Fikazon Technologies Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
• You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the App without prior written consent from Fikazon Technologies Ltd.
• User-generated content (such as usernames and profile information) remains your property, but you grant us a worldwide, royalty-free license to use, display, and distribute such content within the App and for promotional purposes.

6. Advertisements

ARITHMOS may display advertisements from third-party ad networks (such as Google AdMob). By using the App, you acknowledge that:

• Ads may appear during gameplay transitions, as rewarded content, or in designated areas of the App.
• We are not responsible for the content, accuracy, or practices of third-party advertisers.
• Ad personalization may be managed through your device settings or ad network opt-out mechanisms.
• Viewing certain ads may be voluntary (rewarded ads) or part of the free-to-play experience.

7. Privacy

Your use of ARITHMOS is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the data practices described therein.

8. Availability and Modifications

• We strive to keep ARITHMOS available at all times, but we do not guarantee uninterrupted or error-free service.
• We may perform scheduled or unscheduled maintenance, updates, or patches that temporarily affect availability.
• We reserve the right to modify, update, or discontinue any feature, game mode, or the entire App at any time, with or without prior notice.
• In the event of permanent discontinuation, we will make reasonable efforts to provide advance notice to active users.

9. Termination

We may suspend or terminate your access to ARITHMOS at any time, with or without cause and with or without notice, if:

• You violate any provision of these Terms.
• We reasonably believe your account is being used for fraudulent or illegal activities.
• We are required to do so by law or regulation.
• We discontinue the Service entirely.

You may terminate your account at any time by submitting a deletion request as outlined in our Data Deletion Policy. Upon termination, your license to use the App is immediately revoked, and you forfeit all Virtual Items, progress, and data associated with your account unless otherwise required by law.

10. Disclaimers

We do not warrant that the App will be uninterrupted, secure, error-free, or free from viruses or harmful components. We do not guarantee any specific learning outcomes, educational results, or competitive performance from using ARITHMOS. Any reliance on the App's content or features is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Fikazon Technologies Ltd, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use ARITHMOS.
• This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.
• Our total aggregate liability for all claims arising from or related to the App shall not exceed the total amount you have paid to us in the 12 months immediately preceding the event giving rise to the claim, or ₦5,000 (Five Thousand Naira), whichever is greater.
• These limitations apply regardless of the legal theory under which damages are sought (contract, tort, negligence, strict liability, or otherwise).

12. Indemnification

You agree to indemnify, defend, and hold harmless Fikazon Technologies Ltd, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or any content you submit or transmit through the App.

13. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or your use of ARITHMOS:

• Informal Resolution: We encourage you to contact us first at info@fikazonsms.com to seek an amicable resolution. We will make good faith efforts to resolve disputes within 30 days.
• Mediation: If informal resolution fails, the parties agree to attempt mediation before pursuing formal legal action.
• Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of the Federal Republic of Nigeria.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy, Data Deletion Policy, Refund Policy, and Child Safety Policy, constitute the entire agreement between you and Fikazon Technologies Ltd regarding your use of ARITHMOS. These Terms supersede all prior or contemporaneous agreements, communications, or understandings, whether oral or written.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify users through the App or via email. Your continued use of ARITHMOS after such changes constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the App and request account deletion.

17. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the Nigerian courts.
